Abstract :

A tendency in the modern Qur’┐nic exegetical literature is expressing of scientific and theological intellectualism. Syed A╒mad ╓asan is a renowned Exegete of the 20th century as well as an expert in╒ad┘th and its sciences. In A╒san al-Taf┐s┘r, he has vehemently focused on incorporating reliable and authentic a╒┐d┘th in order to review intellectual approaches and evaluate them for evaluating and resolving the philosophical interpretations of the Qur’an. According to him, the assertions based upon mere logic are far from the true spirit and essence of the divine objectives. This paper has been specifically articulated to explore the views of Zimakhshari from classical and of Sir Syed Ahmed Khan from the relatively modern period.The paper establishes the interpretations according to the spirit of the Qur’an and Sunnah.

Abstract :

Research Citation and referencing of sources make the academic writings authentic, reliable and approachable. A citation is a way of giving credit and acknowledgment to scholars for their creative and intellectual thoughts, ideas and works that are utilized to support the research studies. It is also used to locate particular sources and combat plagiarism. A citation or referencing style is a set of rules, a particular way or a standard approach for documenting and formatting the sources that are quoted, consulted, mentioned, paraphrased, summarized and cited or referred to in the scholarly writings. Proper use of pre-defined citation style helps to make the reference list and bibliography consistent and easy. Different ways or styles have been developed over time to address the specific needs of presenting citations and referencing in different disciplines or professions. Similarly, some instructors or supervisors also recommend a specific style. This paper presents an overview and critical review of the most commonly used citation styles i.e. MLA, APA, Chicago and Harvard along with the Muslim Scholars Style. The paper aimed the orientation of Research Scholars in the field of Islamic and Oriental Studies.

Abstract :

In spite of the fact that Islam has permitted divorce and Khul’ most reluctantly, their ratio is increasing day by day all over Pakistan. Once almost absent in the Pakistani society, the phenomenon of demand for complete separation between wives and husbands on petty issues has nowadays become almost a joke. This state of affairs requires serious reflection. The present article discusses District Haripur in this regard as a case study. Data of divorce and Khul’ cases have been collected from various registered government and non-government organizations. The number of cases of divorce by trying to combine these events closely reviewing their location to identify the causes of divorce and Khul’, if the suggestions and steps highlighted in this thesis are considered it can help in minimizing this evil from the Society.

Abstract :

Effective system of accountability plays a vital role in ensuring the rule of law and eradication of corruption in every society. The non-compliance of accountability results in manifold issues which hinders the growth of society in all spheres. The instances of such issues are obvious in our society which can only be resolved with the help of an effective and comprehensive system of accountability. The accountability system set up by the Prophet Muhammad (PBUH) encompasses all social, economic, moral, religious and worldly matters. Through this system he rectified everything that could possibly lead to any mishap and disturbance in the society. It is the man himself who is responsible for making or marring a society. That is why Islamic law emphasized a lot on moral and social values, social harmony, and discouraged immoral and dishonorable acts.The presnt article discusses the role of Accountability in reformation of the society from Islamic perspective.

Abstract :

In the opinion of Dr. Muhammad Y┴suf al-Qara╔┐wi, the famous Egyptian scholar of Islam, wearing niq┐b for Muslim woman is not obligatory. He however, respects the opinion of those scholars who are in its favour but does not agree with some sheikhs who regard it as an innovation or tradition that has no base in Islam. According to him majority of scholars agree that face is not `awrah (something to be veiled in the presence of members of the other sex). But a school of fiqh holds the view that it is `awrah and that wearing niq┐b is obligatory, a view espoused in some Muslim countries, such as in the Gulf region, especially those among them who follow the ╓anbali School of fiqh. Moreover, Muslims in India, Pakistan, Bangladesh and Afghanistan have also adopted this opinion, even though they follow the ╓anafi School. He expressed his views about the matter of niq┐b in one of his legal verdicts (fatw┐) declaring the covering of face, i.e. wearing niq┐b for a Muslim woman saying that "If a Muslim woman is convinced that wearing the niq┐b is obligatory and the face is `awrah, we have to respect her choice and avoid being an obstacle to her religious commitment. We should not force her into a situation contrary to her conviction. I call on European countries to respect the personal and religious freedoms of people, of which they are advocates. Abstract :

The scholars of Prophetic Traditions (Muhaddith┴n) have divided ╒ad┘th into many categories. According to authenticity of narrators it has three sub categories i.e. ╖a╒┘╒ (sound), ╒asan (good) and ╔a’┘f (weak). The first two are unanimously acceptable by all scholars of ╒ad┘th however they have differed about the last type. Some of them are of the view that a weak ╒ad┘th is acceptable in certain conditions while others hold opposite opinion. Keeping in view its weaknesses and strength, a ╔a’┘f ╒ad┘th is further sub divided into many types. Acting upon the directives mentioned in a weak ╒ad┘th has been a hot topic of debate among scholars down the ages. In this paper, the acceptability and non-acceptability of ╔a’┘f a╒┐d┘th is discussed in the light of the contemporary situation.

Abstract :

The Qur’┐n, while referring to the past nations and destroyed civilizations has clearly presented the idea that ‘Nature’, or in Islamic terminology “the Will of Allah”, does not work blindly and arbitrarily, and there are certain historical reasons leading to every change or revolution which the Qur’┐n calls the ‘Sunnah of Allah’. The Qur’┐nic way of referring to ancient peoples, and their civilizations and of exhorting the faithful to learn a lesson from their history, clearly show that “Islam is a religion essentially history conscious”. Ibn Taymiyyah is one of those few Muslim scholars who have fervently foucused upon this subject by adopting a distinct methodology than others on the subject of mush┐jar┐t al-╗a╒┐bah, an important part of Islamic history. According to him, it was the impact of pre-Islamic political practices/theories that caused divide and fragmentation of the Muslim Ummah.This article discusses Ibn Taymiyyah’s views and methodology in this regard.
8) وہمِ راوی در روایتِ حدیث اور فقہی مسائل پر اس كے اثرات: امام ابن عیینہ كی روایات كا اختصاصی مطالعہ

Abstract :

Differences in legal issues are closely linked to the differences in isn┐d (chain of narrators) and mut┴n (texts of the narration) of A╒┐dith. There may be numerous causes of these differences, such as tafarrud (uniqueness) of a narrator; relating the meaning and sense of the narration (al-Riwayah bi al-Ma'n┐), or Wahm (erroneous impression) of the narrator. These differences can be resolved when all the ═uruq (routes) of the narration are gathered. Im┐m al-Sh┐fi’┘, Im┐m Ibn Qutaybah and Im┐m ║a╒┐w┘ are amongst those scholars who have authored books in this field of Islamic sciences. Erroneous impression of the narrator is one of the important causes of difference in isn┐d and mut┴n of A╒┐dith, which is also the subject of this paper. This paper focuses on the erroneous impression of a trustworthy narrator Im┐m Sufy┐n b. ’Uyaynah through his narrations and tries to examine the narrations, in which he has disagreed with other trustworthy narrators due to his erroneous impression. Similarly, this paper also examines the nature of impact, which this disagreement has put on the jurisprudential issues.

Abstract :

The conflict between ╒aq & b┐═il, i.e. virtue and lie, right and wrong has started since the day of existence of the universe and it reshapes from time to time. Similarly, its causes vary with respect to space, time, events and thoughts. The fight is not bad in itself because it produces some good and positive results. In this article, we shall be analyzing the struggle between truth and untruth and its causes while discussing the possible solutions in the light of Ras┐’il al-N┴r of Imam N┴rsi. We shall also be providing some valuable suggestions and advices for the success of the truthful group among people.

Abstract :

A cautious reader of “life” in the j┐hiliyyah (pre-Islamic era) learns much of the virtues and vices of the ancient tent-dwelling pagan Arabs. In spite of their few wants of life one can come across with bulky mentions of a variety of dissatisfactions, injustices, wars, feats, sheep grazing and raids. This state of affairs had had a negative impact on the life of a pre-Islamic poet; his life became a burden to him and that he passed his time in tension and anxiety losing his status in the society. The present article mentions the major reasons of ╘ulm (injustice) in pre-Islamic society and its impact on the life of a poet.

Abstract :

The approach of the experts of ╒adīth sciences towards some ruw┐t (narrators) of a na╖╖ (╒ad┘th text) is neither absolute acceptance nor absolute refusal regardless of whether they are authentic or unauthentic. Even the authentic narrators’ text can be rejected on the basis of the context in which the text is narrated. Likewise, the unauthentic narrators’ text should not be rejected in the context where the narrator is assumed to be authentic. The narrator might have been of weak memory, but his reported text may be accepted because of his long companionship to that particular Sheikh whereby he acquires strength. The present article is limited to the study of unauthentic narrators whom text about a particular Sheikh has been accepted by Ab┴ D┐w┴d in his Sunan.The objective of the study, which has been conducted by going deeply through relevant reliable sources of the field and the opinions of experts, is to extract and identify such narrators and narrations. It was found that Im┐m Ab┴ D┐w┴d has authenticated quotes of six weak narrators from a particular Sheikh, namely: Ayy┴b b. Suwayd, ‘Amr b. ‘Uthm┐n, Qurrah b. ‘Abd ar-Ra╒m┐n, al-Muthann┐ b. al-╗ab┐╒, Muj┐lid b. Sa’┘d, and Hish┐m b. Sa’d. While the number of their quotations reach to forty three nu╖┴╖, i.e. twenty four (Hish┐m b. Sa’d), twelve (Muj┐lid b. Sa’┘d), four Qurrah b. ‘Abd ar-Ra╒m┐n, and one each of Ayy┴b, ‘Amr and al-Muthann

Abstract :

Leadership in Islam is considered as a trust and a responsibility. A leader is required to meet his obligations to Allah sub╒┐nahu wa ta’┐la, the Supreme Power as well as to discharge his duties towards the people (makhl┴q) or his followers to the best of his abilities. Islam tells the rulers that the authority vested in them is not their private property but is a trust and that they should discharge the obligations of that trust to their utmost. If rulers will not rule according to the truth and justice revealed from Allah sub╒┐nahu wa ta’┐la or will look down upon the principles delivered from His Prophet, they will certainly be led astray from the “straight path” and as a result will put themselves and their followers in trouble. The present article covers the aspect of method of giving advice to Muslim Rulers in light of the Sunnah along with explanation of relevant terms. The article argues that keeping in view the practice of previous Islamic scholars the faults of Rulers should not be publicized or propagated from the pulpits as it will lead towards grave disorder in the society.

Abstract :

Islamic Law gives great importance to property after protection of human body. Numerous legal verdicts have been laid down to protect it from any kind of aggression or transgression. Islamic law has provided punishment to those who steel someone’s property from his custody without his consent. It has also been ordered to not eat one’s property illegally. If someone is killed in protecting his own property from an aggressor, he, in the eyes of Islamic Law is a martyr. In Islam, significance of property is also proved from the last sermon of the Prophet (PBUH) who mentioned it immediately after sanctification of human blood.The present article discusses the viewpoints of different jurists regarding protection of property who have argued about its ╒ukm. Most of the jurists opined that protection of property is obligatory while some others are of the view that it is only permissible. The article also discusses the situation if the aggressor is killed during the process of defence of the property by the owner. Abstract :

Faith in spiritual being was a result of many fears, considered as evil working against human beings. Religion became a source to fight this evil, and therefore, it existed throughout the human history, though there were periods where it was thought to be losing its vigour. With the passage of time different judgments developed over the debates regarding religion and politics. Religion was linked with civilization by many scholars or, in other words, was explained and identified based on its followers’ milieu despite the fact that one civilization had followers from different faiths. In addition, civilizations are differentiated by history, language, culture, tradition and religion. The process of globalization, on the one hand, increased the interaction among different civilizations and, on the other, intensified the differences and commonalities among them. The study explores whether religion and politics have direct bearing on each other and whether they influence individual and state behaviour or not.
15) Islam and Pakhtunwali: Convergence and Divergence of Religious and Cultural Identities among the Pakhtuns of Pakistan

Abstract :

Pakhtuns of Pakistan emphatically identify themselves with cultural code called Pakhtunwali and with their religion Islam. The centrality of Islam and Pakhtunwali to Pakhtun sense of belonging is widely recognized in the literature. However, there is dearth of literature that would provide rigorous analysis of the relationship between Islam and Pakhtunwali. This study intends to provide such an extensive analysis. The study postulates that the literature represents dichotomous positions on whether Pakhtunwali and Islam coalesce or diverge. The paper also argues that there is growing disjunction between these identities as expressed by Pakhtun nationalist and religious elite in their discourse on identity and conflict in the region. Moreover, this discourse is not only discernable in cyber space (online discussions) but is also observable among the masses in various parts of Khyber Pakhtunkhwa such as Malakand.
16) Limit of Wait for Waiting Wife of a Missing Person

Abstract :

Marriage is a sacred legal contract in Islam. The Prophet (PBUH) has declared it compulsory (w┐jib) for both man and woman. It is considered half of religion, while the remaining half can be saved by taqw┐. Unfortunately when this relation breaks or is lost all of a sudden, then women and kids suffer in each financial, physical and social spheres of life. A woman feels insecure and confused in case her husband is missing and no news or whereabouts of him are known to anyone. The main purpose of the present research is to overcome the problem of uncertainty and hardships created by this situation for the suffering wife and her progeny and to illustrate that the Islamic shar┘’ah has discussed the issue amply and has provided the sufferer her due rights in the absence of her husband.

Abstract :

The presence and significance of religion and religious beliefs in public affairs cannot be ignored. Almost every day we come across, through media, the instances which demonstrate that various individuals, groups and institutions which hold the religious realm have an enduring and significant relevance in political sphere. Whether it is the legislative process in a particular country; political violence in a certain society; or the voting behavior of a specific group or community, religion and religious beliefs evidently play an essential role in shaping and molding these socio-political attitudes.
